Family Law in Ontario is a complex area of law, which involves many statutes, rules, regulations and precedents. It may feel overwhelming for a lay person to even obtain an uncontested divorce, which is a comparatively straightforward procedure. It is quite telling, therefore, that as of today, paralegals are not allowed to represent family law clients: there is usually too much at stake in a family law proceeding and extensive knowledge is required to deal with equalization, child and spousal support, custody and many other corollary matters involved in a family law dispute.
A family law lawyer may become involved at different stages of your family life: from the time you start cohabiting with someone, at which time you may need a Cohabitation Agreement to protect your interests, at the time of your separation and/or divorce, until much later after the divorce/separation – if either child or spousal support, or custody and access are involved.
It is advisable to consult a lawyer before you sign any document related to a family matter or title to property.
